From these examples, it is clear that goals flow from vision. After setting the goals, the implementation process begins. This involves translating the goals into actions or formulating strategies to ensure the goals are achieved. For the organization purpose to be achieved, every department in the organization should work towards a common goal since each department has specific actions to perform that flow from the goals. For example, to â€Å"ensure a safe community† the commu nity development agency is required to â€Å"develop and implement programs to deter and alleviate the effects of illegal behavior† (2). ... However, for these actions to be enacted, the support in terms of funds, equipment, and manpower is needed; thus, the budgetary allocation is crucial. Through the roles assigned, each department in the city is made aware of what is expected if the council is successful in its endeavor. Identification of vision, goals, and actions is vital in strengthening the government’s budgeting process. From the vision, achievable goals are set, and in order to achieve the goals, some actions must be performed. In this case, if the actions are performed as expected, it means the vision, as well as the purpose of the organization, will be achieved. For this to happen, resources in terms of finance, materials and equipment, and manpower with required skills are needed. Where do the resources come from? The government has to provide the resources needed for successful implementation of goals, but it cannot just give out resources without a plan. It has to establish how much is needed in order to achieve each goal and allocate resources accordingly. Some goals which are more important are given more priority than others. Some actions can also enhance the implementation process by these means reducing the need for financial allocation. For example, by employing a highly skilled diverse workforce continuously, there is a possibility to ensure improved systems and high-quality services to customers and to develop the required programs. Thus, it is crucial for the government to have vision and objectives, so as to allocate resources efficiently for the overall success of government services and economic growth.

She comes from a rich background and always associated with the rich but decided to marry Peter because she wanted some adventure and uniqueness. She found the rich folks too snobbish and thus she chooses someone different, and that was Peter who was a towel boy at the time. The couple has three children and Chris is one of them. He is just as fat as his father and even just as dumb. In the series he is constantly being attached by an Evil Monkey from his closet, the evil monkey usually comes out of the closet and points at him only. Meg the daughter is usually the ignored child and her family members ignore her as if she never existed and they only focus on her when they are teasing and making fun of her.

Globalization and Indigenization Relationship In this paper we will try to understand the relationship between indigenization and globalization by looking at how globalization in its process acts as a tool for homogenizing certain culture and lifestyle as ideal over others and often works mainly through the market, media, music and other technology. Secondly we will also look into how globalizations try to reinforce itself through indigenization by adapting certain popular local culture which are selective and therefore marginalized certain culture over others in a society. Therefore, we will focus mainly on social, economic and cultural life of state and people in globalization era and will be looking through the lens of social science perspective. For further clarity we will also look at experiences of some countries in Asia that are changing due to globalization as an empirical evidence. In this paper I would like to argue that globalization and indigenization are interrelated and that globalization is an economic drive for p rofit maximization and therefore in the process of setting up markets it creates homogenization; and indigenization of selective cultural manifestation which often leaves out other cultures and creates tension within a pluralist society In social science discourse it is very difficult to define any term. Globalization, term origin of concept can be seen as first used by Roland Robertson according to Malcolm Waters, which came at the background of countering Immanuel Wallertein theory that has a heavy base on economy, Robertson suggested therefore that globalization is a phenomena both taking place in human consciousness and culture. For our present paper we will be looking at globalization as an economic process mainly driven by the so called developed or the western world through international financial bodies that ultimately challenges culture. Globalization therefore means a global economic process that controls international economy and nation state governance as trade and investment process produces growing interconnection between nations. Hirst and Thomson (1999, 8-10) said that interconnection between nations often result in the form of nations specializations and the international division of labours. The im portance of trade also becomes increasingly centralized which acts as the organizational principle of the system. They become internationally autonomous and socially disembodied, as market and production becomes truly global. Domestic policies becomes predominantly international determinate. This creates a systematic interdependence as it is transform to be permeated by and for international. Thus, globalize economy posed a problem to the domestic actors in formulating its policies. Globalization according to Petra and Veltmeyer (2001, 11) carries both descriptive and prescriptive meanings, descriptive as  [1]  globalization referring to the widening and deepening of the international flows of trade, capital, technology and information within a single integrated global market. Prescriptive as globalization involves the liberalization of national and global markets in the belief that free flow of trade, capital and information will produce the best outcome for growth and human we lfare (UNDP, 1992). On one hand, there are scholars like Keith Griffin (1995) who considers globalization as inevitable and needs adjustment for both necessary and possible human development. On the other hand, there are some who view it as a class and not as a process, the network of institutions known as the global economic system is an intentional and contingent, subject to the control of individuals who represent an seek to advance the interest of a new international capitalist class, this class consists of TNCs, World Bank, International Monetary Fund, etc and all these financial institution form a new system called global governance. Barnet and Cavenagh (1994) term this as a global financial network. Here the question do not only boils down to whether globalization is inevitable or not as we need to be very critical on this issue but for this paper we should move further and say that globalization is an economic process that is driven by few powers to regulate, generate and su stain capitalism. At the meantime globalization process can also be seen as the dissemination of religion and culture; it evolves interaction of people, groups, communities mainly through trade and commerce. Sociology study on globalization focus on the processes and flows in society whether at local level, national or global level. Sociologist like Barrington Moore, Charles Tilly, Theda Skocpol and Immanuel Wallerstein have looked at society broadly to understand connections of human lives with various field like economics, culture, media, technology etc, so, in short globalization is a process driven for economic growth by few international institutions that controls the process and outcome of global economy. Indigenization The term indigenization originates from the meaning indigenous. According to Websters New World Dictionary defines Indigenous as existing or growing naturally in a region, country, Sefa Dei (2002) said indigenous knowledge as unique to a given culture or society characterized by the common sense ideas, thoughts, values of people formed as a result of sustained interaction of society, nature and culture. In Sociology indigenous mean to integrate ones refection on the local culture and society or history into his or her approaches. Yet it is important to note that not all culture is indigenous for eg in Yangs article he clarifies that indigenous culture in Chinese context was to study traditional Chinese culture I.e. Confucian tradition and not local tradition like Gelao tradition in Taiwan. Indigenous people constitute more than 70% of the world out of which 250 million people lives in Asia. They are known by different names like hill tribes in Thailand, Scheduled Tribe in India, cult ural communities in Philippines, minorities nationalities in China etc. Heterogenisation, globalization, hybridization and indigenization have all become part of the wide ranging cultural studies in different discourse and debate about the diversity of local interaction with global capitalism. Roberston (1995, 28) states relation to globalization with culture said that in numerous contemporary accounts globalizing trends are regarded as in tension with local assertions of identity and culture. Here we will not be focusing so much on identity but look at how social cultural practices gets undermined in globalization. Globalization and homogenization We will now see how globalization process works as homogenizing tools that are often selective in nature and homogenized certain culture over another leaving out the importance of plurality of a nation. According to Nederveen Pieterse (2004)  [2], there are  [3]  three views on the issue of globalization. The first view looks at globalization as clash with civilization as expressed by scholars like Samuel Huntington. The second view is expressed by the term Mcdonaldisation of the world that would also mean homogenization of particular culture over others, that often overlooks at the plurality and differences of cultures diversity. The third view is based on hybridization and synthesis, as this view suggest that much of the worlds culture has evolved through exchanges, mixing or diffusions where there exist a constant movement and interaction between people who are the carrier of culture. Here the idea of homogenization and indigenization becomes quite critical as it is driven b y the market economies that are profit driven, which we will look at as we proceed further. To understand globalization and homogenization we will argue on the first and second view of globalization as stated earlier, as a clash of civilization and mcdonalization through global financial network. .Yamashita argued that the history of Southeast Asia itself can be a good example of glocalisation.The Economist (10 Oct 1994) predicted that China would be the worlds largest economy by 2020 overtaking United State and also the developing countries will dominate more than 60% of the worlds economy leaving just 40% with the developed countries. The experiences of many Asian countries like Hongkong, South Korea, Taiwan etc showed rapid economic growth in early 1990s. Global economic institutions like World Bank 1993 reports The East Asian Miracle observed and perceived these policies to be stable, market friendly policies with internal and external financial market liberalization to attract foreign investment. However, by late 1990s the economy of East Asian went into crises, which World Bank commented as inability to turn their domestic banks into western style institution that emphasis on transparency and rational market oriented criteria. On the other hand, addressing this same problem Hirst and Thompson (2002) said that South Korea and Singapore have suffered the most in this crises as they both depended heavily on short term loans from international financial institutions, and generally they concluded that the nations were heavily depended on the Western advice, and receiving praise for it from such institutions as the IMF which complimented Thailand on its macroeconomic policies in 1996. Polity was driven by conformity with Western doctrine. Thus, East Asian Crises clearly showed the bias policies of the West to expand its market that often demands so much from the recipient nation to make their policies favorable foe investment otften at the cost of the nation. Still there are some scholars like Khondker who argues that intellectual closure to others will close dialogue between societies or nations. He urges that in globalization era nations should open up yet not be a blind imitator of western ideas and concepts and give importance to local context and values. This crisis shows how global financial institutions controls and directs the policies of other developing nations and homogenized certain western values as ideal values over local values. State sovereignty in the process itself becomes restructure and reorganized through globalization, it systematically becomes a puppet at the hands of the financial giants, so there should be a space and right for nations to reject or reform or influence the policies and conditions that will affect them. There is also this tension with globalization as on one hand it seems to be creating diversity yet on the other hand it has further strengthen localization. According to Ritzer, McDonaldization does not represent something new but, rather, the culmination of a series of rationalization processes that had been occurring throughout the twentieth century. He said that globalization is not necessarily westernization. At some point this argument seems acceptable but as we look around we cannot ignored the McDonaldization as the popular culture even in India shows more Americanization as top chart music are dominated by popular singers like Madonna, Rihanna etc or hip hop culture, all the latest loud style statements are made through foreign products like Nike, Addidas, Puma, Samsung, Vodaphone etc, television shows like Simpsons, American Idol, Friends etc capture the popular media culture. McDonald, KFCs international food joints are seen in every cities and in many products they modify or indigenized it with selective culture to fit into new culture a classic example can be the introduction of aloo tikki in McDonald menu or nimbu pani drink s in KFC menu. The process of globalization started with trade and commodities now is moving towards services. Globalization and Indigenization The term globalization and indigenization have become a coveted term. According to Samuel Huntington in, The Clash of Civilizations and the Remaking of World Order he argued that because of new ideas like modernization, urbanization and mass communication and the end of Cold War there will be contest of ideology, this would lead to a conflict that will not be based on ideology or economy but on culture. His prediction seems to be coming true as we see the contestation worldwide on globalization and indigenization that challenges the base on culture. The impact of globalization on culture is seen differently by different scholars. Some like transformative says that culture is evolving and changing therefore needs interaction that will promote integration and removed negative cultural barriers. Spectics have argued that it will create uneven cultural globalization, Many other see it as a negative influences upon each other, as the global financial institutes like IMF policies has shown very bias approach driven for economic profit. The growing protest against international organizations meetings like G-8, European Union in Seattle, Washington, Genoa and Barcelona is a proof of growing discontent among many people. Indigenization of certain culture becomes important question as we see that it is intractably related with the state, identity and economy. Lieber and Weisberg suggest that culture within globalization have to do deeper than its surface phenomena and McDonald, American music, language, art and lifestyle has within it a form of alienation that owes to the changes and disruptions brought by modernization and globalization. They argued that in Middle East, South Asia and Africa there is a rage of anger against corrupt and authoritarian rule, which came into being after the breakdown of their traditional social, political and economic relationships. Thus, these new institutions fails to meet the needs of the societies thereby there is a deep resentment agai nst the Americans that have pose a challenged to identity  [4]. They considered culture as an area of contestation. The US, considered as the main actor of globalization has been playing a dual role in sustaining and protecting capitalism. The United States of America with less than 5% of the worlds population accounts for one fourth of its economic accounts. They have all captured power in international institutions and dominate world economy. Thereby, homogenizing popular culture of other nations. American English is the most common spoken language in the world; approximately 380 million people use English as their first language and 250 million as their second language. A German diplomat Karsten Voight with US said that The USA has long been setting standards on a worldwide basis, not just for the general populace, but has been leading the field in the classic cultural spheres, for example in research and teaching, or films and modern art. Its global role rooted in a hitherto unknown blend of economic power, the ability to set the global cultural agenda and military superiority. (International Journal of Politics, 2002, p277) Media also plays an important role for indigenization process as Hollywood films captures more audiences than any other film production company. As there are many generations of men who grew up all wanting to be a cowboy as the influence of cinema was very strong in earlier time, even though due to space and time, physical constrains the degree of homogenization might be lesser though am not denying the massive lifestyle influence that time. Now, we can see that social and cultural globalization over lapse with commercial economy. The global media are control by few countries through radio, internet and cinema. There are scholars like Ben Beakidn, who wrote Media Monopoly and argued that global economy is controlled by only few countries. He gives an example that by 1998 only six Multi National Corporation or MNC control more than half of world social and cultural life like Disney, other minor MNCs were Fox, BBC, Microsoft, Yahoo all these are dominated by developed nations and even localized within their territory, I would like to argue here that these MNCs acts a major tools for homogenizing and indigenizing western culture that gets strongly reinforce through popular mass media and this has intensify due to continue interaction over the years under rapid globalization era. These social and cultural phenomena as seen above often subscribe to few dominant cultures mainly term as Americanization that creates a universal history. Media has created soft power in homogenization and indigenized few cultures at the expense of other, eg in India the introduction of cold drinks like Pepsi, Coke, Sprite etc has wiped out many traditional drinks like Lassi or nimbu pani, and many traditional small scale earner that depended on these trade for livelihood are displaced and almost non existent now, we can also see now market also commodities goods like the introduction of packet nimbu pani which are projected as more healthy over traditional drinks. There are hardly any si gns of traditional culture of lifestyle especially in the market like traditional earthen pots ghara as water cooler is almost non existence, which are natural, environment friendly and healthy. The indigenization process that caters to new customers for profit by selecting popular culture over other are very evident as discussed earlier the introduction of aloo tikki or vegetarian menu in McDonald, the latest fashion are also projected as wearing certain logos and tags like Reebok, Adiddas, Nike (JUST DO IT) etc replacing traditional attires like kurtas and salwar kameez, though we see them yet still but we need to realized that many traditional trade that deal with these product are now non existent or struggling for survival as new technology can produce the same more efficiently and in large amount, which makes the traditional product more expensive and since so called rational consumer goes for cheaper goods it ultimately lead to the decline of some efficient traditional cultur e. This phenomenon also artificially creates a division among people as we also see the indispensable growth of Trans national elite in every society. There are greater connection among people around the world and which also lead to some positive outcome like growth in Human Rights Movement, Feminist movement and Environmental lobbies etc. not overlooking the positive aspects of globalization as well we can still argue and before we can conclude it would be interesting to ponder on what Gupta (2007, 88-89) writes in chapter title Business as Usual that globalization bring in new ideology that are clearly visible in which business are projected in India, trade union has been laid down, productions are driven by consumers want it is no longer about employment, economic independence or strong trade union. In this competitive capitalist process unfortunately for country like India it poses a problem to citizenship and neglect of underprivileged people. Business or corporate giant in Ind ia are part of family business so it puts family above all else, this vividly captures the state of India present scenario that is driven for economic growth and profit driven in globalization world and has intensified over the years. Conclusion Through this paper I have tried to highlight the underlying current of globalization that is basically driven by few developed countries mainly US. Globalization as a process starts and ends with economic expansion, by which it homogenized selective culture and projects it as superior over others and indigenized itself to be accepted as it enters new markets. In this process globalization creates a complex phenomenon that creates contradiction within the notion of culture, for some nation like Singapore globalization has been beneficial as they are driven with the quest for latest technology as they have high standard of living in generally. However, for a nation like India it is problematic as we have seen that by homogenizing and indigenization only selective culture dominants over other and India been a pluralist country with so much of diversity. The roles of citizens also greatly diminish as there is no space for choice, so underprivileged sections of society bears the greatest burden. There should be a constant effort on the part of nation to provide substantive equality to citizens make welfare policies free from any foreign influences. Culture keeps changing and evolving but we should keep in mind that any chances should be directed to make every individual live a respectable and dignified life and in right cultural context.

Eighteenth-century English jurist Sir William Blackstone declared in a magisterial passage, â€Å"By marriage, the very being or legal existence of a woman is suspended, or at least it is incorporated or consolidated into that of the husband, under whose wing, protection, and cover she performs everything, and she is therefore called in our law a femme-covert† (The Nineteenth Century Intro. Pg. 171). It was not until 1848, in the married woman’s property act of New York that women gained some rights regarding material possessions. Education (differences in what men and women are taught) A â€Å"liberal education† as described in Defoe’s Essay on Projects, 1697, consisted mainly of embroidery, modeling in wax, painting on glass, and musical accomplishments, although some girls’ schools did put on plays and teach cooking skills. Most girls were trained for domestic service at the charity schools for women, and there was no form of formal higher education, such as college, available for women. Oxford, Harvard, Cambridge, Yale and Princeton were all solely men’s institutions. Also, while women were taught mainly the native tongue and perhaps French, men had more extensive opportunities to learn other such Roman and Greek languages. (An essay in Defense of the Female Sex, 1696) Also, if a woman did obtain any extensive knowledge other than the normal trades taught at school, she was urged to keep quiet about it lest men be jealous of her intelligence. This is evident in Evelina on page 3 61 where Mrs. Selwyn is criticized for being an intelligent and logical woman in a time where women were supposed to be quieter and not engage in a match of wits with someone, especially a man, as we see Mrs. Selwyn challenging the intelligence of Mr. Lovel. These are all reasons why women authors during this time chose a pseudonym when publishing their books for fear that they would be ridiculed and their work not accepted for the mere fact... ... not know how to handle this situation. p. 384 Where Evelina is pleading with her father to see her and she here is the picture of what a good mannered woman should be- humble and gracious. Image as applies to association with people of questionable character: Although they are her family, Evelina is completely embarrassed to be seen with the Branghtons and Madame Duval because they are such loud, rude, unrefined characters. They are not of the same social standing as her and they know even less than Evelina how to behave in social situations with grace and dignity. Pg. 233 where Evelina is separated from her party at the fireworks event and asks two ladies to protect her and they turn out to be prostitutes and Lord Orville sees her with these women and Evelina is completely embarrassed at her predicament because it makes her look bad. While he was initially criticised for not paying close enough attention to the ‘local characteristics', he did find an individuality in his work through the landscape and atmosphere of Tasmania. His depiction of the Tasmanian light is bright and clear and his gum trees are very convincing, with their stalky form and sparse and scraggly foliage. However the strong influence of romantic artists Claude Lorraine and Gaspard Poussin lingers in his work. Hence Glover’s work has a very European flavour. It is also very picturesque and has an air of a peaceful Utopian land. This romantic, pictorial and esthetically pleasing style of painting has striking differences to the artistic techniques used by Russell Drysdale, Lauren Berkowitz and Barbara Reid Napangarti. Throughout his lifetime he travelled extensively however his artistic focus remained on outback rural Australia. Because he spent the majority of his life in Australia his paintings show minimal European influence. This in itself creates a great contrast between Glover and Drysdale. Another significant difference is that Glovers paintings are impressionistic while Drysdale's artworks are expressionistic. This expressionist style broke away from the tradition Australian landscape art practices present in his era. Unlike Glover, Drysdale preferred to work form from sketches, photographs and his memory when composing. When Drysdale worked on his paintings he worked hard, however it would quite often be a long and agonising experience. He was the first artist to investigate the desert and rural outback-Australian life for a prolonged period of time. This intensive exploration gave rise to the central themes of many of his artworks. Some of these themes included the issue of alienation of indigenous people, isolation of rural life, multiculturalism and national identity. The ‘Red landscape’ is a perfect example of these themes. It shows the landscape surrounding Mount Olga in the Northern Territory. The dead twisted tree trunks, and extremely vivid colours express a strong mood of isolation and desertion. Although the artwork is not as realistically precise as Glovers ‘Constitutional Hill at sunset’, it manages to express the true essences of the Australia desert. There is a house and washing blowing in the wind but there is no presence of human being, or anything living for that matter. This gives a bleak, depressing feeling. Lauren Berkowitz Strata, 1999, sand and gravel, 14 x 7m Mc Clelland Gallery, Victoria Photo: John Gollings Birth: 1965, Melbourne – Lauren Berkowitz is a contemporary installation artist. Installation art can be described as a three-dimensional painting, sculpture, poem, and prose work, which is usually transient and site-specific. This very modern art practise makes Berkowitz’s expression of Australian landscape is completely different to the previous two artists, Glover and Drysdale. Her work is made with an almost obsessive attention to detail after painstaking research and, ultimately, total dedication to the moment of making. Similarly both Glover and Drysdale were very focused and particular about their artworks. Unlike Glover and Drysdale, Berkowitz does not use paint at all, nor does she depict the landscape realistically. Instead she collects materials and items from the specific environment and creates a symbolic sculpture. Often they evoke complex thoughts, longings, and moods and have multiple meanings. Her works usually revolve around the themes of land degradation, environmental disasters and the human impact on the land. We can see these themes displayed in the artwork ‘Strata’, which gives a give a compelling moral message of our obligation and responsibility to the earth and its sustainability. One can also draw many parallels between this artwork and Aboriginal artwork. For example like indigenous art Strata is based around symbolism. Also the earthy colours depicted are very similar to that of indigenous desert artworks and, like traditional Australia tribal artists, Berkowitz is not interested in constructing lasting monuments but rather temporary works that can be returned to the landscape. Although it is not as extreme in Drysdale’s work, one can also draw parallels between his use symbolism and Berkowitz. WOMAN'S HEALING CEREMONY Medium: Acrylic on Belgian linen. Image Size: 120 x 75 cm- illustrated Australian Encyclopedia Aboriginal Artists, page 256, Barbara Reid Napangarti (B. 1962-) Barbara Reid Napangarti Barabara Reid Napangarhi was born in Tjukurla, in Western Australia. She belongs to the Pintupi tribe and is the daughter of the world-renowned artist Nigura Napurrula. Ried paints important cultural stories of women's dreaming associated with her region. The paintings explore the unique desert country of her homeland. Although Drysdale focused on a similar landscape they both portrayed the barren area in two very different ways. This is because Reid has a completely different art practice to Drysdale and Glover. However she does share some similarities with Berkowitz. For example they both use symbols, lines and patterns to show the Australian landscape. The painting titled â€Å"Woman's Healing ceremony† depicts the ceremonial site of the healing ceremony in her homeland Tjukurla. Like all her paintings it carries a deep spiritual meaning. This is what differentiates her work form the three earlier artists. Glover simply gives an impression of the beautiful landscape around him, Drysdale gives a more expressionistic depiction of the Australian landscape and Berkowitz gives a symbolic personal message about the Australian landscape. Reid however includes the landscape into her dreamtime stories through symbolism that is common to her people.

Natural Justice Essay

4) What is natural justice? Natural justice is a natural sense of what is right and wrong. It is a procedural concept and does not imposed any substantive restriction. Besides that, natural justice is also a fair administrative procedure to be followed by the administrative body in arriving at a right decision. Natural justice has two main components; the rule of hearing or rights to be heard or audi alteram partem and the rule against bias or nemo-judex in causa sua. 5) What are the main elements in nemo-judex causa sua? Nemo-judex causa sua means the rules against bias. It means that a man should not be a judge in his own cause. The principle that bias disqualified an individual from acting as an adjudicator flows from two fundamental maxims; a man should not be a judge in his own cause; and justice must not only be done but be seen to be done. The fountain of administration justice must not only be pure but it must also enjoy public confidence and credibility. The adjudicator must not only be free from bias but there must not even be appearance of bias. There are three types or elements of bias; Pecuniary bias, Personal bias and Policy bias. A pecuniary interest, however small, in a controversy disqualifies a person from acting as a judge. In DIMES v GRAND JUNCTION CANAL, a public limited company filed a case against a land owner in a matter largely involving the interests of the company. The Lord Chancellor who was a shareholder in the company heard the case and gave the desired relief to the comp any. The decision was quashed by the House of Lords because of the Lord Chancellor’s pecuniary interest in the company. Personal bias may arise in the adjudicatory right, or in favour of, one party to the dispute before him under many varied circumstances, for example relationship, friendship or business dealings with or hostility or animosity against a party may disqualify an official to act as an adjudicatory in a dispute. All these circumstances create bias either in favour of, against a party to the dispute. In AK KRAIPAK v UNION OF INDIA 1970 SC 150, a Selection Board was formed to select employee of state service to the Indian Forest Service was one of the candidates and he was a member of the Selection Board. The Supreme Court held that a member of a decision making body cannot be both a party and a judge in the same dispute. In the case of official bias, the adjudicatory is not influenced by any personal or pecuniary but he is so imbued with the desire to promote official policy of his department that he becomes blind to the existence of the interests of the private individual. When an administrator acts as decision maker to decide a dispute between an individual and his department, there is a tendency that he was an official or policy bias towards his department. In ALKAFF & CO v THE GOVERNER-IN-COUNCIL, the Commissioner of Law was a member of Singapore Improvement Trust (SIT). SIT approved certain scheme and applied to the Governor-in-Council for approval. The Governor appointed the Commissioner to inquire and to make report on the proposal. The commissioner recommended approval of the scheme. Therefore held, the appointment of Commissioner to inquire the merit of the scheme could result in suspicion that justice might not be done. The order was quashed. 6) What is the element in audi alteram partem? Audi alteram partem is the rule which requiring fair hearing. It has few elements. The first element is notice. Notice is a basic norm of natural justice is that before initiating adjudication proceedings, the party concerned should be given notice of the case against him so as to enable him to adequately defend himself. The right of hearing become illusory if the party has no knowledge of allegations which he need to meet. Notice thus regarded as the sine qua non of the right of hearing. The notice means an adequate notice as regards the details of the case against the party. Any proceeding taken against a person without adequate notice to him infringes natural justice and is thus invalid. It is necessary that all the grounds on which action is proposed to be taken must be communicated to the person concerned. If it transpires later that action was taken on a ground which had not been taken communicated to him earlier than the action will be invalid. In the case study of MARADANA MO SQUE TRUSTEES v BADI-UD-DIN MAHMUN [1967] 1 AC 13, the government took over the school on two grounds due to the failure to pay salaries of teachers and unable to manage the school, but the manager was asked to explain only one ground which is the failure to pay salaries. The managers had no notice of the other grounds, which influenced government’s decision. Privy Council held that the decision to take over the school was quashed as the managers were not given notice of one ground. The minister was acting in quasi-judicial capacity and was bound to observe the rule of natural justice. Relating to the case above, a notice must be served in order for the person concerned to know the charges he had to meet; and have a sufficient time to prepare his defence. For example, in the case of SURINDER SINGH KANDA v GOVT OF MALAYSIA [1962] MLJ 169, Lord Denning stated that if the right to be heard is to be real which is worth anything, it must carry with it a right in the accused man to know the case which is made against him. The notice must be given a reasonable opportunity to comply with its requirements. Sufficient time must be given to the concerned person to prepare his defence. For example, in the case of RE LIVERPOOL TAXI OWNERS’ ASSOCIATION [1967] 2 MLJ 186, a letter was sent to the association to show cause by return of post against the issue of fresh taxi licenses. The notice was held to be inadequate. It is against natural justice to call upon the concerned person to show cause immediately and to permit him no time to consider the charges against him. If the notice is inadequate, the decision will be invalid as it is against the natural justice. The second element is hearing. Natural justice requires an adjudicatory body to not to make a decision adverse to a party without affording him an affective opportunity of adequately meeting the allegations against him and presenting his own case. There is no fixed hearing procedure which has to be followed in all cases. It varies from situation to situation. It is ultimately for the court to decide whether the procedure adopted in a specific situation accords with natural justice or not. In the case stu dy of PHANG MOH SHIN [1967] 2 MLJ 186, the inquiry officer embarked on the inquiry immediately after reading the charge to the officer against whom the inquiry was being held. His request for an adjournment to enable him to prepare his defence was refused. It was held that there was a denial of natural justice. The third element is reasonable opportunity of being heard. There are certain elements need to be observed. The first element is the adjudicating authority should disclose all information, evidence or material which the authority wishes to use against the individual concerned in writing at its decision. The general rule is that all the relevant material which is being relied upon by an adjudicating authority for giving its decision against a person, should be brought to his notice and he be given an opportunity to comment, criticise, explain or rebut the same. For example in the case of AZIZ BIN ABD RAHMAN v ATTORNEY GENERAL SINGAPORE [1979] 2 MLJ 93, the court held that as vital and relevant evidence had not been disclosed to him, there was breach of natural justice insofar as he was denied an opportunity of correcting or controverting the medical evidence considered relied upon by the medical board. The second element is the authority should receive the evidence and all relevant material which the party concerned may wish to produce before it in its defence. In an oral hearing, the adjudicatory authority is obligated to give the person concerned opportunity to produce evidence on behalf of the affected person may amount to breach of natural justice by the authority concerned. Based on the case MALAYAWATA STEEL BHD v UNION OF MALAYAWATA STEEL WORKERS [1978] 1 MLJ 87, the company challenged an award of the Industrial Court on the ground of breach of natural justice as the company was denied the opportunity to call witnesses. The High Court held that there had been a denial of natural justice when the applicant was not allowed to call his essential witnesses to adduce evidence at the hearing and was therefore denied a reasonable opportunity of presenting his case. The third element is the authority should give to the individual concerned an opportunity to rebut the material against him. In oral hearing, cross-examination of witnesses testifying against a party should be permitted. It is actually not regarded as an obligatory part of natural justice in all cases. Whether an opportunity for cross-examination is to be given or not depend upon the circumstances of each case. Based on the case CEYLON UNIVERSITY v FERNANDO, the argument of the appellant that he had not been given an opportunity to cross-examine witnesses testifying against him was rejected by the Privy Council on the ground that he never claimed such right. Even where cross-examination of witnesses is allowed, the authority may refuse to permit unnecessary cross-examination of a witness. Even if cross-examination of witnesses is not an obligatory part of natural justice, it is still necessary for the decision-making authority to give the party concerned a fair opportunity of comment ing on the evidence produced against him and of contradicting the same. The fourth element is reasoned decision. Traditionally, the British courts had taken the view that natural justice does not obligate an adjudicatory body to give reasons for its decisions. In BREEN v A.E.U. [1971] 2 Q.B. 143, Lord Denning did emphasize that the giving of reasons is one of the fundamentals of good administration. The obligation to give reason avoids unfair or arbitrary decisions by adjudicatory bodies; search for reasons for their decisions is bound to make these bodies alert and careful. Reasoned decisions ensure that decision-making bodies apply their mind to the facts and circumstances of the matters they decide and that they do not act in a mechanical manner. In India, however, the Supreme Court has insisted time and again that natural justice obligates decision-making bodies to give reasoned decisions. The fifth element is the right to be counsel. Generally, appearance of a lawyer is not claimable as a matter of right in a quasi-judicial hearing. But in a case where complicated questions of law and fact arise, where the evidence is elaborate and the party concerned may not be in a position to meet the situation himself effectively, denial of legal assistance may amount to denial of natural justice. In PEET v GREYHOUND RACING ASSOCIATION [1968] 2 ALL ER 545, the Court of Appeal ruled that natural justice required that the plaintiff should be presented through a lawyer as he was facing a serious charge concerning his reputation and livelihood. However in the case of FRASER v MUDGE [1975] 3 ALL ER 78, the court ruled that in a disciplinary matter there was to be hearing but no legal representation. In this case, a prisoner with an offence against prison disciplines sought legal representation before the Board of Visitors while enquiring into the charge before him.
